General Terms and Conditions (GTC)

of ABG Transport OG / Fadu Bike

1. Scope

These GTC apply to all sales, repairs, services and rentals of bicycles, e-bikes, e-scooters and mopeds by ABG Transport OG under the brand Fadu Bike (hereinafter "Seller/Lessor") to customers (hereinafter "Buyer/Lessee").

2. Sale of bicycles and e-bikes

1. All e-bikes are sold exclusively with a maximum speed of 25 km/h in accordance with the statutory regulations.
2. Any modification of the speed by the customer (e.g. tuning or manipulation) excludes the Seller's liability.
3. The Buyer is solely liable for any damage, penalties or legal consequences resulting from such modifications.

3. Right of withdrawal for online purchases

1. In accordance with the Austrian Consumer Protection Act (KSchG), customers have the right to withdraw from the contract within 14 days without giving any reason.
2. The withdrawal period begins on the day on which the customer or a designated third party took possession of the goods.
3. A clear statement (e.g. a letter or email) is sufficient to exercise the right of withdrawal.
4. The model withdrawal form (see section 13) may be used.

4. Effects of withdrawal

1. In the event of withdrawal, all payments will be refunded within 14 days.
2. The refund will be made using the same means of payment that the customer used.
3. The refund may be withheld until the goods have been returned or proof of return has been provided.
4. The goods must be returned within 14 days.

5. Exclusion / expiry of the right of withdrawal

There is no right of withdrawal for:

• Goods manufactured to customer specifications or ordered from a third country at the customer's request.
• Goods that are not suitable for return for hygiene reasons if their seal has been removed after delivery.

6. Warranty and guarantee

1. The statutory warranty period of 24 months from handover applies.
2. Normal wear parts (e.g. brakes, tyres, chains, etc.) are excluded from the warranty.
3. Damage caused by improper use, negligence or manipulation is excluded from the warranty.

6.1 Separate agreement for commercial use

1. If a bicycle, e-bike or moped is used commercially (e.g. by delivery services, courier services or other commercial use), a reduced warranty period of 6 months applies (6 months for e-scooters, 3 months for batteries).
2. For commercial use, the warranty for the battery is also limited to 6 months. Due to the unusual stress (e.g. frequent or excessive charging), the battery is considered a wear part.
   • Replacement or return of the battery under the warranty is excluded.
   • Replacement of the motor is likewise excluded.
3. This vehicle is designed for a maximum load of 90 kg. Overloading due to higher body weight or improper use may lead to increased wear and is not covered by the warranty.
4. The warranty for commercially used vehicles applies exclusively to necessary repairs within the 6-month period of use.

7. Rental of bicycles, e-bikes and mopeds

1. Condition on handover: The vehicle is handed over to the Lessee in technically perfect condition.
2. Notification of defects: The Lessee is obliged to report any damage or defects immediately.
3. Maintenance & inspection: The Lessee is obliged to bring the moped to the workshop of ABG Transport OG / Fadu Bike for maintenance once a month.
   • Normal wear-and-tear repairs are borne by the Lessor.
   • Damage caused by improper use is borne by the Lessee.
4. Return:
   • The vehicle must be returned in the same condition at the end of the rental period.
   • Late return may incur additional costs.
5. Liability: The Lessee is liable up to an amount of €2,300 for damage, loss or theft during the rental period.
6. Repairs: Modifications or repairs may only be carried out with the consent of the Lessor.

8. Prices and terms of payment

All prices are stated in EUR and include statutory taxes and duties. The prices valid at the time the goods are dispatched are payable. Errors and omissions relating to prices, or obvious and easily recognisable inaccuracies and prices that have clearly been manipulated, may be corrected by our company within a reasonable period, even after the contract has been concluded.

Prices do not include delivery costs, which are borne by the customer. For purchases on account (payment by bank transfer), the invoice amount is due immediately.

You can pay online by credit card (Mastercard, Visa, AMEX – no prepaid credit cards). You can also pay with UnionPay, eps, Klarna Pay Later (invoice), Klarna Pay Now, Shop Pay, Apple Pay and Google Pay.

9. Data protection

Personal data is processed in accordance with the GDPR and the Austrian Data Protection Act (DSG). Details can be found in the privacy policy on our website.

10. Liability

1. The Seller/Lessor is not liable for damage caused by improper use, tuning or self-repairs.
2. For rental vehicles, the liability limit in accordance with section 7.5 (€2,300) applies.
3. Liability for consequential damage is excluded to the extent permitted by law.

11. Applicable law and place of jurisdiction

1. Austrian law applies.
2. The place of jurisdiction is the Commercial Court of Vienna (Handelsgericht Wien).

12. Written form

Amendments or additions to these GTC must be made in writing.
